Many previously convicted felons to be permitted to serve as estate executors in Illinois thanks to new law

Under new legislation which will take effect in January, many convicted felons will be allowed to serve as executors of estates in Illinois.

Under previous law, any felony conviction disqualified a person from resolving a decedent’s affairs.

The new law provides that the decedent must acknowledge awareness of the executor’s status, and the executor may not have been previously convicted of exploitation of the elderly, identity theft, or a similar crime.
